Disclosing death when selling a home

In Florida Do you Have to Disclose a Death When Selling Your Home?

If buying or selling a home in Pensacola, FL is in your future, you're likely well versed the entire process from the initial offer to closing. But are you aware that disclosing a death in the home may be required? Here's what you need to know.

Property Disclosure Documents

No matter how perfect a house looks on the outside, there is often property information a buyer needs to disclose before the sale can go through. Property disclosure documents reveal known structural issues, neighborhood nuisances, hazards, HOA details, water damage, notable repairs made to the home and death in the home.

Rules for reporting a death in the home vary by state, and variations in rules may include:

  • Timeframe: When the death occurred.
  • How the person passed away: If the death occurred naturally versus due to negligence on the property.
  • Hauntings: If the seller has knowledge that the property is being haunted by the dead.

So, what are the rules in Florida? Here are the details according to the 2020 Florida Statues:

689.25 Failure to disclose homicide, suicide, deaths, or diagnosis of HIV or AIDS infection in an occupant of real property.

(1)(a) The fact that an occupant of real property is infected or has been infected with human immunodeficiency virus or diagnosed with acquired immune deficiency syndrome is not a material fact that must be disclosed in a real estate transaction.

(b) The fact that a property was, or was at any time suspected to have been, the site of a homicide, suicide, or death is not a material fact that must be disclosed in a real estate transaction.

(2) A cause of action shall not arise against an owner of real property, his or her agent, an agent of a transferee of real property, or a person licensed under chapter 475 for the failure to disclose to the transferee that the property was or was suspected to have been the site of a homicide, suicide, or death or that an occupant of that property was infected with human immunodeficiency virus or diagnosed with acquired immune deficiency syndrome.

For a state-by-state guide on disclosure laws we recommend visiting this resource on Nolo.com

Remediating After a Death in a Home

If a death recently occurred in the home you're hoping to purchase, there may have been biohazards from bloodborne pathogens that required remediation. Consider asking the seller how the death was remediated to ensure proper steps were taken. Remediation processes may vary depending on the location of the death, how the death occurred, types of flooring, and if the death was undiscovered for days or weeks.

Bio-One technicians are trained and equipped to properly disinfect biohazards from bloodborne pathogens, and we ensure safe biohazard material handling and disposal. Once the entire area is cleaned of blood and body fluids, we also help property owners restore the location to its pre-incident state.

If you are selling a home and need a biohazard remediated or want to ensure remediation was done correctly, give Bio-One a call. Our experts not only contain and disinfect the dangerous biological materials, we carry out our work in a caring and private manner.

Social Isolation and the Elderly

Even though states are beginning to open, there will still be a percentage of elderly adults who will stay home in order to ensure safety and health. Unfortunately, social isolation can be harmful to people. Some older adults already live alone, and now that they are forced to stay home to avoid COVID-19

According to the National Institute on Aging, “there has been research that linked social isolation and loneliness to physical and mental conditions: high blood pressure, heart disease, obesity, weakened immune system, anxiety, depression, cognitive decline, and even death.”

The CDC gives some recommendations to relieve stress and cope with social isolation:

  • Take breaks from watching, reading, or listening to news stories, including social media. Hearing about the pandemic repeatedly can be upsetting.

  • Make time to unwind. Try to do some other activities you enjoy.

  • Connect with others. Talk with people you trust about your concerns and how you are feeling.

We also recommend cleaning and disinfecting any items that come into your home from family, food delivery, mail, etc. This will minimize the spread of germs.

COVID-19 Tips to Stay Safe

Now that business and beaches in Florida are starting open, it is important to follow a couple safety rules to stay safe. The CDC recommends the following tips to help prevent the spread of Coronavirus.

  • Stay home when you are sick
  • Cover your cough or sneeze with a tissue, then discard in trash
  • Avoid close contact with people who are sick
  • Avoid touching your eyes, nose, and mouth with unwashed hands
  • Wash your hands often with soap and water for at least 20 seconds
  • Use an alcohol-based hand disinfectr that contains at least 60% alcohol if soap and water is not available
  • Clean and disinfect frequently touched objects and surfaces

If you are a business owner, or you are consistently working with the public, you may want to consider having your establishment disinfected on a regular basis. At Bio-One we are able to disinfect for not only COVID-19, but other viruses such as MRSA, C-DIFF, and HIV.

Coronavirus

As most of you have seen, coronavirus is spreading among us and can potentially be fatal to those with a weak immune system. Symptoms that you may experience after exposure to the coronavirus is: fever, cough and shortness of breath. The World Health Organization (WHO) encourages you to see a doctor if you have these symptoms or if you have traveled overseas recently.  WHO also says “Standard recommendations to prevent infection spread include regular hand washing, covering mouth and nose when coughing and sneezing, thoroughly cooking meat and eggs. Avoid close contact with anyone showing symptoms of respiratory illness such as coughing and sneezing.”

Unfortunately, the COVID-19 is spreading through Florida. Below are the current numbers for Florida Cases.

21 Positive cases involving Florida residents

2 Deaths involving Florida residents

155 Number of pending test results

319 Number of people currently being monitored

The CDC has learned that COVID-19 can spread by person to person. Respiratory droplets produced when a person sneezes or coughs can land on nearby people or on surfaces that we touch. If you touch a surface that someone has coughed on, and then touch your face then the virus may spread to you.

It is extremely important that any place impacted by COVID-19 be decontaminated properly. At Bio-One, we are ready to decontaminate any residential or commercial properties. If you are faced with this difficult task, please call us at 850-855-6349.

New Year Resolutions

Suicide is the 10th leading cause of death in the United States. The most significant factors that lead to suicide is mental health disorders and substance use disorders. Environmental stressors may also increase the risk of suicide.

As we enter 2020, we encourage you to check on your friends and family, but also take steps to ensure your mental health is in a good place. Below we will list just a few things you can do that may help improve your quality of life. Sanam Hafeez, PsyD, an NYC-based licensed clinical psychologist, explains, "It takes a lot of mental toughness, self-love, and discipline to create the life you want."

1.    Clear Your Clutter: “Cluttered spaces can reflect a cluttered mind” says Haffez. If you are stressed, anxious, or depressed you may start to feel better once you organize and clear your space from unnecessary clutter.

2.    Exercise a Little Bit: Set small goals, for attainable wins. Dr. Hafeez advises that some people set high goals and when they fall off in a month, this leaves them in a depression state. Set realistic goals, such as walking 10,000 steps a day.

3.    Bring a Friend: Having a workout partner can make going to the gym more enjoyable, but it can also help with accountability.

4.    Consume Mind Boosting Foods: Eat foods such as fish and nuts which are high in omega-3. Adding mind boosting foods to your diet can help with memory and concentration.

5.    Apologize and Forgive: "Carrying around resentments and guilt wears us down and, believe it or not, can lead to serious illness," says Hafeez. Forgiveness is not for the other person, but for you to free and move forward.

6.    Learn Something New: Challenge your brain! Trying something new like yoga, a new language, cooking, etc. "The more we can activate the cognitive functions of our brains, the better our short- and long-term memory, as well as our hand-eye coordination will be," Dr, Hafeez explains.

Happy New Year!

Mental Health During the Holidays

The holidays are normally a time to bring the family together, eat good food, and count your blessings. But for some, the holidays can cause anxiety, stress, and even depression. Symptoms like these can sometimes increase the risk of suicide as well.

The National Alliance on Mental Illness (NAMI) says that the holidays can increase financial burden due to gifts, travel, or hosting parties. Others may experience extreme loneliness due to the loss of loved one or being away from loved ones. On top of these scenarios, there are usually high expectations put on people to find the perfect gift and host the perfect party.

NAMI has listed some ways to cope with or manage your mental health during the holidays.

1.     Stay in Therapy: Even if you are overwhelmed, continue to make time for your therapy appointments if you currently seeing a therapist.

2.     Mindfulness: There is a Mindfulness toolkit that offers free mindfulness resources, such as guided meditation for beginners.

3.     Don’t Rely on Drugs and Alcohol: Substance can make stress, depression, or anxiety even worse. Proceed with caution if you’re already feeling down.

4.     Soak up the Sun: Even if it is cold where you are at, if the sun is out, go take a walk! “

5.     Set Realist Expectations: At the end of the year, we tend to look back at our accomplishment and/or failures. This causes some, to feel like they “should be” at a different spot in their life. Try to step out of this mindset, by setting realistic expectations and focusing on what lies ahead.

We hope this helps some during their holiday stress. Please remember to keep a good self-care routine and see mental health counseling if need be.

Happy Holidays!

988: 3 Digit Suicide Hotline Number

As some of you may know, suicide continues to be on the rise. Just last year, Lifeline counselors answered over 2.2 million calls and over 100,000 online chats in response to those having suicidal thoughts. The Lineline phone number currently is 1-800-273-TALK, but that will be changing to something much shorter and easier to remember in times of a crisis.

The FCC has decided to vote in favor of establishing 9-8-8 as the new number that people can call if they are having suicidal thoughts. These calls would go directly to the National Suicide Prevention Lifeline, which has 163 cruises centers.

This will most likely take place in 2021 or around 18 months. But as Mordecai Dixon, Director of Organization Development at the Crisis Center of Tampa Bay said, “Anything that provides an access point is a good move.”
